European Social Charter: Follow-up to the decisions of the European Committee of Social Rights in the context of the collective complaints procedure

In 2023, the Committee of Ministers, acting in accordance with Article 9 of the Additional Protocol to the European Social Charter (ESC), providing for a system of collective complaints, adopted three resolutions to take note of the European Committee of Social Rights’ reports in which the Committee concluded unanimously that Italy had not violated the ESC. The resolutions are:
- Resolution Confederazione Generale Sindacale (CGS) and Federazione dei Lavoratori Pubblici e Funzioni pubbliche (FLP) v. Italy, Complaint No. 161/2018: no violation of Article 6.2 ESC, right to bargain collectively, namely, the state’s commitment “to promote, where necessary and appropriate, machinery for voluntary negotiations between employers or employers' organisations and workers' organisations, with a view to the regulation of terms and conditions of employment by means of collective agreements”);
- Resolution Associazione nazionale sindacato professionisti sanitari della funzione infermieristica - Nursing Up v. Italy, Complaint No. 169/2018: no violation of Article 6.2 ESC);
- Resolution Sindacato autonomo Pensionati Or.S.A. v. Italy,Complaint No. 167/2018: no violation of Article 12.3 ESC, right to sociale security, namely the state’s commitment “to endeavour to raise progressively the system of social security to a higher level”).
