European Committee of Social Rights: the Collective complaints against Italy in 2024

2024 has been the year of complaints under the sign of the right to work and fair remuneration

In January 2024, the European Committee of Social Rights received two collective complaints from two Italian organizations. 

On 2 January the Confederazione Unitaria di Base (CUB)- Organization Protecting Workers’ Rights registered complaint No. 234/2024 related to Article 1 (the right to work), Article 4 (the right to a fair remuneration), Article 12 (the right to social security) and Article 30 (the right to protection against poverty and social exclusion) of the revised European Social Charter. The organization alleges that Italy breached provisions of the Charter by failing to provide for any form of universal basic income or legal minimum wage level. A high rate of poverty and social exclusion remains in the country, as does the increasing percentage of workers earning below the poverty threshold. 

The second complaint against ItalyNo. 236/2024, was registered on 12 January by the Sindacato Italiano Lavoratori (S.I.Lav). The case relates to Article 1.1 and (the right to work), Article 4.1 and Article 4 (the right to a fair remuneration) and Article 6.4 (the rights to collective bargaining) of the revised Charter. The main complainant union’s charges are made against the Ministry of Education, which applies a difference in treatment of education workers. The differences in career progression, terms of salary and seniority between teachers who had previously worked in public schools and those who had previously worked in private schools with the same experience and professional standing, breach the aforementioned provisions of the Charter.
