Statistical data on cases regarding Italy dealt with by the European Court of Human Rights in 2022

The statistical data provided by the European Court of Human Rights updated to December 2022 reports that the pending applications against Italy amount to 3,550, corresponding to about 4.8% of the total. In a worse situation are Romania, with 4,800 pending applications, equal to 6.4% of the total, Ukraine (10,400, 13.9%), the Russian Federation (16,750, 22.4%) and Turkey (20,100, 26.9%).

In 2022, the Court received 1,931 valid individual applications alleging a violation of the rights contained in the ECHR by Italy (there were 1,610 in 2021, 1,497 in 2020 and 1,454 in 2019). In the same period, 1,950 applications were declared inadmissible or struck out of the list; 179 unilateral declarations (there were 142 in 2021); 85 friendly settlements (there were 236 in 2021); 27 judgments on the merits, 25 of which found at least one violation of the Convention. Overall, the Court found the following violations: 1 concerning the right to life under Article 2 ECHR; 3 concerning the right to an effective investigation under Article 2 ECHR; 3 concerning the prohibition of torture and inhuman treatment under Article 3 ECHR; 2 concerning the right to an effective investigation under Article 3 ECHR; 2 concerning the right to liberty and security under Article 5 ECHR; 4 concerning the right to a fair trial under Article 6 ECHR; 2 for excessive length of proceedings under Article 6 ECHR; 3 relating to the execution of a judgment under Article 6 ECHR; 10 concerning private and family life under Article 8 ECHR; 5 for the lack of an effective remedy under Article 13 ECHR; 2 concerning the protection of property under Article 1, Protocol 1 ECHR.

784 applications have been communicated to the State for examination on the merits. The ECtHR also received 88 requests for interim measures under Article 39 of the Rules of Court, mainly concerning the suspension of expulsion proceedings for as many applicants; only 5 of them were granted by the ECtHR.
