The twelfth Parliamentary Report on the implementation of Law 68/1999 on the right to work for people with disabilities has been published

The twelfth Parliamentary Report for the 2022–2023 biennium on the state of implementation of Law of 12 March 1999, No. 68, entitled "Provisions on the Right to Work for People with Disabilities" has been published.

The authors themselves acknowledge that the data presents anomalies and cannot always be considered reliable. The difficulties stem from the lack of adequate IT support and from the transmission of data by provincial offices without any form of verification. This critical issue could be addressed through the introduction of a national IT system. Compounding this problem are persistent structural inequalities related to geographical origin, gender, and type of disability among people who turn to employment offices.

A first key issue concerns the quantification of registrations and re-registrations at employment offices: the number of people registered with intellectual and mental disabilities remains particularly unclear. In 2023, the total number of registered individuals amounts to 880,997. However, the average annual number of new registrations over the decade from 2013 to 2023 is approximately 73,569 and, even accounting for those who have reached retirement age, at least 200,000 registered individuals would still be unaccounted for. An overall estimate suggests that the total number of registrants should exceed one million.

Regarding job placements, an analysis of the report raises concerns about future employment prospects. Since 2015, under Legislative Decree No. 151/2015, companies have been able to independently select workers with disabilities and subsequently request authorisation for hiring from the relevant provincial employment office. This is known as nominative hiring, and it differs from numerical hiring, which occurs when a company, having failed to comply with its legal obligations, is required to hire a candidate designated by the Disability Employment Office. On average, numerical hirings represent a negligible number of cases, not captured by the XII Report under Law 68/99. This risks highlighting how employment is only marginally supported by the public placement system.

Over a ten-year period, 401,847 people found employment through these services, with an annual average of 40,184 placements, equal to 4.01% relative to the estimated one million registered individuals. Furthermore, the report shows that 83.72% of these (corresponding to 336,448 people) lost their jobs within 12 months. Only 16.28% of those who found employment retained it in the long term. Against this backdrop, the report also highlights 178,328 unfilled positions within the reserved quota system established by Law 68/1999.

On 10 March 2026, the Council of Ministers approved the Triennial Action Plan for the Promotion of Rights and Inclusion of People with Disabilities 2026–2028, subsequently signed by President of the Republic Mattarella on 25 March. The Plan sets out a series of measures aimed at supporting people with disabilities in their job search and helping employers achieve inclusive and equitable workforce integration.
