Comparative techniques for the protection of human rights: critical approach to traditional classifications Silvia Bagni
Following a comparative approach, the author addresses the new dimension of constitutionalism, which no longer wonders on the «if» of the human rights recognition but rather on the «how» and on the «how much» of the effective protection. Assuming the distinction between direct and indirect-institutional protection, the problem of the effectiveness is analysed with special reference to the techniques of indirect protection, those that aim at protecting the «democratic form» of the State and are classified as meta-garantees.
